Please read these Terms and Conditions thoroughly. I will refuse your commission if you don’t agree to or accept these terms.

I have the right to refuse any commission for any reason at any point before a payment request is sent.

One song per request - I will automatically decline requests with more than one song.

Please submit all files in the correct format (see Audio File Submission Guideline below).

Once I accept your request, you will be contacted via discord or other preferred methods.

Clients who have commissioned and/or received work before this ToS has gone into effect are still bound to its contents.

By commissioning me, you confirm all audio materials you provide are lawfully acquired, or would fall under fair use.

You will agree here to the policy of using my services for personal, non-profit purposes unless otherwise stated, and provide all service credits to me, ‘Haliya’ with a link to either my twitter (https://twitter.com/HaliyaVT) or carrd (https://haliyavt.carrd.co/).

Redistribution or Reselling my services (Timing/Tuning, Mixing, Vocal Guides) is prohibited.

Vocal guide commissions that exactly follow the original version of the song may be made available for purchase in my vocal guide shop after a month.

I may showcase the final product of the commission in my portfolio.

I do not allow further modifications to any work I produce without written permission. This includes but not limited to remastering, editing, and stem extraction.

Usage of any work I produce in a derivative work (remixing, AI usage, NFT project inclusion, or other) is strictly prohibited.

I retain personal usage rights to the produced work unless otherwise agreed upon in writing. Please contact me for details.

Prices listed do not include applicable tax! Taxes will be applied at checkout.

Prices must be paid up full and upfront before I begin work. Once all payment and files are received, I will begin work.

Charge-backs are strictly prohibited.

A full refund will be provided if you would like to cancel and I have not started or made minimal progress on a commission once the first deadline has passed. 'Minimal progress' for a mix refers to incomplete timing or tuning, and little to no effects applied.‘Minimal progress’ for a vocal guide refers to incomplete track mapping (laying down the base guides to be tuned, timed, edited).

For mixes further progressed, I will provide a maximum 50% refund if you wish to cancel.

In the case that I am unable to meet any given deadline (after the first deadline) after accepting a request, a full refund will be issued.

As Turnaround Times may vary for different commissions, please plan ahead. In the event that you need the commission to be done before the general turnaround time, you will be charged an extra rush fee (see below). I do NOT provide same day services.

Vocal files MUST be ready before commission. Failure to provide complete vocals will result in an automatic declined request.

The quality of the final product will depend on the quality of the recordings that I receive. To ensure a satisfactory final product, please see the Audio File Submission Guidelines below.

On-vocal and Off-Vocal (instrumental files) must be provided by the client (for both mixing and vocal guide clients).

All files must be uploaded together via zip file in Google Drive, Dropbox, etc.

Any submitted files will be assumed to be final. I may ask for retakes (if there are minor changes to be made) or decline a commission altogether if any of the following guidelines below are not followed.

All vocal files must be unedited. Be sure that there is no distortion or clipping in the recordings.

Audio files must be delivered to me in mono, 44.1/48kHz, 24-bit .wav format.

Be sure that your recordings have little to no background noise. Recordings must be free of major impeding factors (eg. other people talking in the background, loud fans, dog barking, door slams, etc.) and clients should make their best efforts to minimize other noise or any reverb/echo/reflections.

Overlapping recordings must be on separate files.

Including a 10-second recording of room tone for noise removal on vocal tracks is not required, but is highly appreciated!

Submitted vocals must be reasonably in-tune and on-time with the provided instrumental. I do my best to make the time and tune sound as natural as possible so please keep in mind that the farther you are from the target pitch and rhythm, the less natural you will sound after tuning.

Commercial use will be subject to an additional fee, determined on a case-by-case basis.

Commercial use is defined as: use in monetized videos or distribution on monetized platforms (Spotify, Apple Music, etc.); or use by a corporate organization or a client belonging to a corporate organization

Personal use includes any other non-monetized media (such as non-monetized YouTube uploads).

I commit to delivering the final product with four or fewer vocalists in 2-4 weeks depending on the service.

For full mixes, I will provide 3 WIP updates: 1 after the finished Time and Tune, 1 after the full mix is completed, and 1 after the final mastering is completed. WIPs outside of completed mixes are typically not included in services. Clients may include them in their request, but the acceptance or fulfillment of them is up to my discretion.

Clients can expect to receive all deliverables included in a service within the turnaround time specified in the service description unless otherwise agreed upon. Should a client require a specific hard deadline, it must be included in the service request.

Deadlines under the expected turnaround time may incur a Rush Fee, which will be determined on a case-by-case basis. If the deadline is too short, I may not be able to take your request as I do have a full time job outside of my mixing and streaming hobbies.

Final files will be delivered through Discord, Google Drive, or other preferred method.

Once the commission is completed, the final files will be kept on the platform they were delivered through for up to one month. After this period, they will be deleted.

I am not responsible for any files lost after this one month period and cannot guarantee my ability to re-upload or replace them.
